Voting against the nomination of the first openly gay male Chief Justice based on his “lifestyle” would be shameful, shocking and deplorable

Justice Andrew McDonald could become the first openly gay male chief justice of a state Supreme Court, if confirmed by Connecticut General Assembly. However, according to state Democrats cited in the AP, the Connecticut GOP appears to have voted against Justice McDonald because of his “lifestyle.”

Democratic legislative leaders in Connecticut said Tuesday they believe the sexual orientation of Gov. Dannel P. Malloy’s choice for the state’s next chief justice may have cost him support among some Judiciary Committee members during a 13-hour confirmation hearing that ended in a tie vote, putting the nomination in jeopardy.

Justice McDonald’s nomination to be Chief Justice of the Connecticut Supreme Court deserves a fair vote that is not rooted in bias and prejudice based on sexual orientation. If it’s true that the tie vote in the judiciary committee was based on his “lifestyle” then the Connecticut GOP should be ashamed.

Every judicial nominee that has come before the Connecticut legislature for a boat has had a sexual orientation — as well as a race, gender, and ethnicity. We should celebrate what it would mean to the integrity of the judiciary to have a judicial bench that truly reflects the the rich diversity of the communities they serve. But an individuals identity should not be used against them when evaluating whether they serve with independence, integrity, and distinction.
